Terms & Conditions
You must be aged 18 or over to purchase age-restricted products from this website. Required age verification must be completed before an order can proceed. 1. These terms These terms cover use of the Wildfire Vape online shop and the supply of e-cigarettes and related products to you. Please read them before placing an order. They explain who we are, how we provide products, how an order may be changed or ended, and what to do if there is a problem. Nothing in these terms excludes or limits your statutory consumer rights. 2. Who we are and how to contact us We are Wildfire Vape Limited, a company registered in England and Wales, trading as Wildfire Vape. For online orders, email online@wildfirevape.co.uk . For general enquiries, email info@wildfirevape.co.uk . You can telephone 01323 920040 . Postal enquiries: Wildfire Vape, 21 London Road, Riverhead, Sevenoaks, TN13 2BU, United Kingdom. Returns must instead be sent to the address in our Returns & Refunds policy . We may contact you using the telephone number, email address or postal address provided with your order. “Writing” and “written” include email. 3. Orders and age verification Placing an order is an offer to buy. Our acceptance takes place when we email you to accept your order, at which point a contract comes into existence. Please keep your order number for any enquiry. If we cannot accept an order, for example because a product is unavailable, a price is incorrect, there is a safety issue, the destination is unsupported or age verification cannot be completed, we will tell you. If payment has already been taken for an order we cannot fulfil, we will arrange the refund due. Only destinations and services offered at checkout are supported. Do not assume that we can ship a product internationally merely because you can view it on the website; contact us before ordering if you are unsure. We cannot sell age-restricted vaping products to anyone under 18. The store uses VerifyMyAge for required age checks during checkout. Relevant identity, contact, delivery and basket information is shared for that purpose. If additional evidence is required, use the provider's secure hosted process. The storefront's initial age notice is not proof of age. A failed, incomplete or inconclusive required check cannot authorise a purchase. See our Privacy Policy . 4. Our products Product images are illustrative. Colours may appear differently on different screens and packaging may change. This does not affect your rights if the goods supplied are materially different from their description. Please check your selected flavour, nicotine strength, colour, size and compatibility before paying. Read and follow the manufacturer's instructions, battery-safety advice and product warnings. Nicotine is highly addictive. Keep vaping products, liquids and batteries away from children and pets. 5. Changes you request Contact us promptly if you want to change an order. We will tell you whether this is possible and explain any change to price or delivery before asking you to agree. Changes may no longer be possible once an order is dispatched. Your cancellation rights are described below. 6. Changes we may make Products or packaging may change to reflect legal or regulatory requirements or minor technical or safety improvements. If a change materially affects the product you ordered, we will explain the available options and your applicable rights rather than substitute a different product without agreement. 7. Delivery Available delivery services, charges and any qualifying free-delivery offer are shown at checkout. See our Delivery Information . Unless another time has been agreed, we will deliver as soon as reasonably possible and within 30 days after accepting your order. If an event outside our control delays supply, we will take reasonable steps to inform you and reduce the effect. Your statutory rights to end the contract or obtain a refund for non-delivery are not excluded. Check that your address is correct and follow the carrier's instructions after a missed delivery. If goods are returned because delivery or collection could not be completed, contact us to agree the next step; any reasonable redelivery charge will be explained before you agree to it. You become responsible for the goods when you, or a person you nominate, take physical possession, except where the law provides otherwise. Ownership passes when the goods have been paid for and dispatched. 8. Cancellation and changing your mind For most online purchases, the Consumer Contracts Regulations give UK consumers 14 days from receipt of goods to tell us they wish to cancel without giving a reason, and a further 14 days to return the goods. If an order is delivered in separate instalments, the relevant period normally runs from receipt of the final item. In addition, our published goodwill policy offers UK customers 30 days from delivery to return unopened, unwanted goods in their original condition and packaging. The conditions of this additional offer do not restrict the statutory cancellation right or your rights concerning faulty or misdescribed goods. The change-of-mind right does not apply to goods sealed for health protection or hygiene purposes once unsealed after delivery, where the legal exception applies. This does not remove rights relating to faulty, unsafe or misdescribed goods. You may also be entitled to end the contract because of a significant delay, a material error we have told you about, or another breach of your legal rights. 9. How to cancel, return goods and obtain a refund To tell us you wish to cancel, email online@wildfirevape.co.uk or call 01323 920040 . You may also send a clear written cancellation statement, or use an available request in your account. Please provide your name, order number and enough information to identify the purchase. Return goods to Wildfire Vape, 50 High Street, Newhaven, East Sussex, BN9 9PA, United Kingdom. Include your order details and keep proof of posting. Our published terms provide return postage through Royal Mail; contact us to arrange the method. We cover reasonable necessary return costs for faulty or incorrect goods as required by law. Safe-return instructions are needed for damaged batteries. For a statutory cancellation, refunds include the cost of the least expensive standard delivery option where applicable, but not the extra cost of an upgraded service. Where the law permits, we may deduct an amount reflecting loss of value caused by handling beyond what is reasonably allowed in a shop. We make refunds to the original payment method. For a statutory cancellation, we refund within 14 days of receiving the goods back or evidence that they have been sent back, whichever is earlier. Other refunds are made within the period required by applicable law. Your bank or payment provider may take additional time to display the funds. See our Returns & Refunds policy for the practical steps. Optional cancellation statement You may email or post the following, but you do not have to use a particular form: “To Wildfire Vape, online@wildfirevape.co.uk, 50 High Street, Newhaven, East Sussex, BN9 9PA. I give notice that I cancel my contract for the following goods: [describe goods]. Ordered on / received on: [date]. Order number: [number]. Name and address: [your details]. Date: [date].” Include a signature only if sending the notice on paper. 10. If we need to end the contract If you do not provide information required to fulfil the order or do not allow reasonable arrangements for delivery, we may contact you to resolve the issue and, where lawful, end the contract. We will explain the reason and any refund due. We will not withhold sums or impose charges contrary to your statutory rights. 11. Faulty goods and complaints We are legally required to supply goods of satisfactory quality, fit for purpose and as described. Depending on the circumstances, the Consumer Rights Act 2015 gives you rights to reject faulty goods, obtain a refund, repair or replacement. A manufacturer's warranty or our additional warranty does not replace or shorten those rights. Contact us with your order number and a description of the problem. We may ask for photographs or other reasonable information to help resolve it. Sale items have the same statutory rights as full-price items. Further guidance is available from Citizens Advice . 12. Prices and payment The applicable product price and delivery charge are shown before payment. Prices are in pounds sterling and include VAT where applicable. If we discover a pricing error, we will contact you where necessary to confirm whether you wish to proceed or arrange cancellation and any refund due. We will not silently charge a higher price. Payment must be made before dispatch using a method offered at checkout. Card payments are handled through the payment provider's hosted process. Promotional codes are subject to their stated eligibility, expiry, limits and minimum spend; the final discount is confirmed at checkout. Contact us promptly if you believe an amount is incorrect. 13. Our responsibility We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights. Products are supplied for domestic and private use. Subject to applicable law, we are not responsible for business losses arising from commercial or resale use, such as loss of business profit or opportunity. 14. Personal information We use personal information as explained in our Privacy Policy . Our Cookie Policy explains browser storage and optional external content. 15. Other terms We may transfer our rights and obligations to another organisation, but this will not reduce your rights under the contract. You need our agreement to transfer your rights or obligations to someone else. The contract is between you and us; another person cannot enforce it except where the law provides otherwise. If part of these terms is found unlawful, the other parts continue to apply. A delay in enforcing a right does not mean that the right has been waived. These terms are governed by English law, without depriving you of mandatory consumer protections that apply where you live. Consumers in England and Wales may bring proceedings in the English or Welsh courts; consumers in Scotland may use the Scottish or English courts; consumers in Northern Ireland may use the Northern Irish or English courts.
